On Thursday, Lucknow bench of the High Court passed an order that there is no error in the decision of the state government to hold centralizing counseling for MBBS and BDS courses in session 2016-17 on the basis of NEET conducted by the Medical Council of India.
Order of State Government :
- The court, however disagreed to the states’ policy by partly passing the orders.
- According to state policy, private or unaided medical colleges have to admit local poor students on 50 percent subsidized seats.
- And remaining 50 percent non- subsidized seats should be filled up on the basis of NEET merit list.
- Those taking admission on non- subsidized seats would pay double fees to compensate for subsidized seats to be occupied by the poor students.
- However the court asked the state government to reformulate the things and conduct the on-going medical counseling afresh.
- It also said that the state would conduct counseling for minorities institutions to fill up the seats as per the rules.
A wide number of petitions :
- The private medical institutes had challenged the state governments’ order on September 2, 2016.
- The petitioners had pleaded that the state had not defined the category of poor.
- If the policy gets implemented, students with less merit will occupy places on subsidized seats.
- While the merit holders would have to compromise with non- subsidized seats.
- Hence, this would disenchant the medical students to choose Uttar Pradesh as their destination for study.
- Thus, it would incur heavy losses to the private medical colleges as well.
- It was contended that the subsidy seats are for aspirants residing within Uttar Pradesh.
- Thus this would lead disparity among the aspirants.
- Some minority institutes had raised the issue that state cannot hold counseling for admission in these institutes.
Considering the submissions, the bench partly allowed the writ petitions of the private medical colleges and asked the state to reformulate the conditions and then hold fresh counseling and complete the admission process till September 25th 2016.
